1. Agreement to These Terms

These Terms of Service ("Terms") govern your use of the Simple Sleep Tests website and any services you purchase from Simple Sleep Tests ("we," "us," or "our"). Please read them before you place an order.

The version of these Terms in effect when you place an order governs that order. If we later update these Terms, the updates apply to future orders and to your continued use of the website — they do not change the terms of a purchase you already completed.

2. About Simple Sleep Tests

Simple Sleep Tests coordinates cash-pay home sleep apnea testing. We are a coordination service, not a medical practice, testing laboratory, or device manufacturer.

Testing, scoring, interpretation, equipment, shipping, secure intake, and payment processing are handled by independent third parties, including testing providers, reviewing physicians, device manufacturers, shipping carriers, our secure intake platform, and our payment processor. Those parties are responsible for their own services.

3. Eligibility

Our services are intended for adults age 18 and older. Availability may depend on your location, whether home sleep testing is clinically appropriate for you, and the availability of participating providers.

You agree to provide accurate and complete information. Payment does not guarantee that home sleep testing will be clinically appropriate for you.

4. Services We Coordinate

Depending on your order, our coordination services may include:

• Payment processing through our payment provider;
• Coordination of a secure health intake form;
• Coordination of device shipment and return;
• Customer instructions and support;
• Coordination with independent testing providers;
• Coordination of physician review of your test data;
• Delivery of your report.

5. Medical Disclaimer and Emergencies

Content on this website is general information and is not medical advice. Simple Sleep Tests does not diagnose, treat, or prescribe, and is not a substitute for a licensed healthcare provider. Independent testing providers and reviewing physicians are responsible for their own professional services.

If you are experiencing a medical emergency, call 911 or go to the nearest emergency department immediately. Simple Sleep Tests is not an emergency provider and cannot respond to urgent medical issues.

6. Payment

The current price for a home sleep test is $300 unless a different price is clearly shown to you before purchase. Payment is required before the test is ordered.

We do not bill insurance. Reimbursement through insurance, an HSA, or an FSA is not guaranteed. For full details, see our Payment & Retesting Terms.

7. Insurance and Treatment Coverage

Your physician-reviewed report may help a healthcare provider evaluate treatment options such as CPAP or an oral appliance. However, Simple Sleep Tests cannot guarantee that an insurance company will accept the test or cover or reimburse any test, treatment, equipment, or oral appliance.

8. Intake and Service Eligibility

After payment, you complete a secure health intake form through our HIPAA-compliant intake partner. The testing provider or reviewing clinician may determine that home sleep testing is not appropriate for you.

If we cannot provide the service you purchased — for example, because you are outside our service area or are determined ineligible before the device is ordered — you will receive a full refund.

9. Testing Providers and Reviewing Physicians

Testing, scoring, interpretation, and other professional medical services may be performed by independent providers and physicians who are not employees of Simple Sleep Tests.

We do not promise a particular diagnosis, result, treatment recommendation, prescription, or turnaround time. Treatment decisions should be made with an appropriate licensed healthcare provider.

10. Testing Equipment

The testing device remains the property of the applicable testing or device provider. You agree to follow the instructions provided with the device and to return it using the process and materials supplied to you.

Charges for lost, damaged, late, or unreturned equipment apply only when the amount and conditions were disclosed to you.

11. Retesting

A repeat test may be necessary if the device does not record enough usable data. You will not be charged a retesting fee when the repeat test is required solely because of a confirmed equipment malfunction, a shipping failure, or another problem outside your reasonable control.

If a repeat test is required because the instructions were not followed, we will explain the reason and any fee and obtain your approval before charging you. See our Payment & Retesting Terms for details.

12. Cancellations and Refunds

Refund eligibility depends on how far your order has progressed — in particular, whether the testing device has already been ordered or shipped. Refunds are available when Simple Sleep Tests cannot provide the service you purchased, including when you are outside our service area or the service is not available to you before the device is ordered.

13. Customer Responsibilities

• Provide accurate, complete, and current information;
• Follow all equipment and testing instructions;
• Use the device only for the intended patient;
• Complete the test and return the equipment within the required timeframe;
• Protect access to your email, reports, and personal information;
• Seek appropriate follow-up care for treatment decisions;
• Use the website and services lawfully and as intended.

14. Communications and Electronic Delivery

We may send service-related communications — order confirmations, intake reminders, shipping updates, and report delivery notices — by email, telephone, or text message using the contact information you provide. You agree that these communications and documents may be delivered electronically.

Promotional marketing messages are separate and require your consent. Placing an order does not sign you up for promotional messages. See our Privacy & Communication Policy.

15. Privacy

Our Privacy Policy explains how we collect, use, share, retain, and protect personal and health-related information. It forms part of these Terms.

16. Acceptable Website Use

You agree not to misuse the website — for example, by attempting to gain unauthorized access, interfering with its operation, scraping or copying it at scale, submitting false information, or using it for any unlawful purpose.

You are responsible for claims arising from your intentional misuse of the website, your illegal conduct, or your violation of another party's rights.

17. Intellectual Property

The website, including its text, graphics, logos, and other content, is owned by Simple Sleep Tests or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from it without our prior written consent, except as permitted by law.

18. Third-Party Services

Some parts of the experience rely on third parties, including our payment processor, secure intake platform, shipping carriers, device providers, and testing providers. Their own terms and privacy practices apply to the services they deliver, and we do not control them.

19. Service Availability

We aim to keep the website and our services available, but access may be interrupted for maintenance, technical issues, or reasons outside our control. We may change, suspend, or discontinue parts of the website or the services we coordinate.

20. Disclaimers

The website and our coordination services are provided on an "as is" and "as available" basis. To the extent permitted by law, we disclaim implied warranties such as merchantability and fitness for a particular purpose, and we do not warrant that the website will be uninterrupted or error-free.

We are not responsible for delays caused by shipping carriers, your own actions, provider availability, equipment shortages, or other events outside our reasonable control — though we will make reasonable efforts to help resolve them.

Nothing here disclaims the professional responsibilities of independent testing providers or reviewing physicians, and nothing here limits our responsibility for gross negligence, willful misconduct, violations of law, or any liability that cannot legally be limited.

21. Limitation of Liability

To the maximum extent permitted by applicable law, Simple Sleep Tests will not be liable for indirect, incidental, special, consequential, or punitive damages arising out of your use of the website or our services, and our total monetary liability for a claim will not exceed the amount you paid us for the order giving rise to the claim.

These limits do not apply where liability cannot legally be limited, including for gross negligence, willful misconduct, or violations of law.

22. Changes to These Terms

We may update these Terms from time to time. Changes apply going forward. The Terms you accepted at the time of your purchase continue to govern that order unless a change is required by law or you agree to the change. When we make material changes, we update the "Last updated" date above.

23. General Terms

• Severability. If any provision is found unenforceable, the rest of these Terms remain in effect.
• No waiver. If we do not enforce a provision, we do not waive our right to enforce it later.
• Assignment. You may not assign these Terms without our consent. We may assign them in connection with a business transfer.
• Entire agreement. These Terms, together with the policies they reference, are the entire agreement between you and Simple Sleep Tests regarding the website and our services.
• Incorporated policies. Our Privacy Policy, Privacy & Communication Policy, and Payment & Retesting Terms form part of these Terms.
