Terms of Service

These Terms of Service ("Terms") govern your access to and use of www.simplesleeptests.com (the "Site") and the home sleep apnea testing coordination services offered by Simple Sleep Tests ("Simple Sleep Tests," "we," "us," or "our"). By using the Site or our services, you agree to these Terms. If you do not agree, do not use the Site or services.

1. Who We Are

Simple Sleep Tests is a service that coordinates cash-pay home sleep apnea testing. We help adult patients order a home sleep test, arrange shipping and return of the testing device, and coordinate review and interpretation of the study by a qualified sleep physician. We are not your treating physician, are not an emergency provider, and do not prescribe treatment.

2. Eligibility

The services are intended for adults age 18 or older who reside in a state we currently serve at the time of testing. By using the services, you represent that you meet these requirements and that any information you provide is true, accurate, and complete.

3. Not Medical Advice; No Emergencies

The Site and services are provided for informational and coordination purposes and do not constitute medical advice, diagnosis, or treatment. Always consult a licensed healthcare provider before making decisions about your health. If you are experiencing a medical emergency, call 911 or go to the nearest emergency department immediately. Simple Sleep Tests cannot respond to urgent medical issues.

4. Cash-Pay Service

Simple Sleep Tests is a cash-pay service. The fee for a home sleep test is $300 unless otherwise stated in writing. We do not bill insurance and do not guarantee any insurance, HSA, or FSA reimbursement. Payment is required before the testing device is ordered or shipped. All fees are quoted in U.S. dollars.

5. Use of the Testing Device

You agree to follow the instructions provided with the home sleep testing device, including how to wear it, how many nights to wear it, and how to return it. The device remains the property of the testing provider and must be returned in a timely manner using the materials provided.

If a test cannot be interpreted because the device was not worn, was removed too early, was used incorrectly, or was not returned, a retest may require an additional fee. Lost, damaged, or unreturned devices may also result in additional charges as set by the testing provider.

6. Refunds

Once a testing device has been ordered or shipped on your behalf, the fee is generally non-refundable. If you believe a refund is warranted because of a device malfunction, a service we failed to deliver, or another issue attributable to Simple Sleep Tests, please contact us and we will review your request in good faith.

7. Patient Responsibilities

• Provide accurate, complete, and current information during intake;
• Use the testing device as instructed and for personal use only;
• Share results with your treating providers as appropriate;
• Seek follow-up care from a licensed clinician for treatment decisions.

8. Intellectual Property

The Site, including text, graphics, logos, and other content, is owned by Simple Sleep Tests or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Site without our prior written consent, except as permitted by law.

9. Disclaimers

The Site and services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of Liability

To the maximum extent permitted by law, Simple Sleep Tests, its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Site or services. Our total liability for any claim related to the services will not exceed the amount you paid to Simple Sleep Tests in the twelve months preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless Simple Sleep Tests from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your misuse of the services, your violation of these Terms, or your violation of any applicable law or third-party right.

12. Governing Law

These Terms are governed by the laws of the state in which Simple Sleep Tests is organized, without regard to its conflict-of-laws rules. Any dispute arising out of or related to these Terms or the services will be resolved exclusively in the state or federal courts of that jurisdiction, and you consent to the personal jurisdiction of those courts.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Site or services after changes are posted means you accept the updated Terms.
